2023-20 CONTRACT FOR CEMETERY SERVICES AND MAINTENANCE

AN ORDINANCE AUTHORIZING AND DIRECTING THE MAYOR OF THE CITY OF VERMILION, OHIO TO ENTER INTO A CONTRACT FOR MANAGEMENT SERVICES FOR THE OPERATION AND MAINTENANCE OF THE CITY'S CEMETERIES.

WHEREAS, the City of Vermilion owns, operates, and maintains Maple Grove and Brownhelm Cemeteries for the benefit of its citizens; and

WHEREAS, the City operates and maintains the Maple Grove and Brownhelm Cemeteries pursuant to its Codified Ordinances and the statutory requirements of the State of Ohio; and

WHEREAS, the costs to operate, maintain and staff the Maple Grove and Brownhelm Cemete1ies are burdensome; and

WHEREAS, the administration of the City of Vermilion has concluded that it is desirable and cost efficient to operate and maintain the City's cemeteries by means of a Management Agreement wherein a manager will provide professional services necessary to operate and maintain the City's cemeteries in accordance with the Codified Ordinances of the City of Vermilion and the statutory requirements of the State of Ohio.

NOW, THEREFORE, be it ordained by Council of the City of Vermilion, Counties of Erie and Lorain, State of Ohio:

SECTION 1: That the Mayor of the City of Vermilion be and hereby is, authorized and directed to enter into a contract for management services for the management, operation and maintenance of the City of Vermilion's Maple Grove and Brownhelm Cemeteries, a copy of said contract being appended hereto, identified as "Exhibit A" and incorporated herein by reference.

SECTION 2: That it is found and determined that all formal actions of this Council concerning and relating to the passage of this ordinance were adopted in an open meeting of this Council, and that all deliberations of this Council and of any of its committees which resulted in such formal actions were in meetings open to the public and in compliance with all legal requirements, including Section 121.22 of the Ohio Revised Code.

WHEREFORE, That this Ordinance is hereby declared to be an emergency measure necessary for the preservation of the public peace, health, safety and welfare of the citizens of the City of Vermilion, the immediate emergency being the necessity and desirability of continuing management services for the operation and maintenance of the city's cemeteries without interruption. Therefore, this Ordinance shall be in full force arid effect immediately upon its passage by this Council and approval by the Mayor.
