2023-45 AN ORDINANCE AUTHORIZING THE MAYOR OF THE CITY OF VERMILION, OHIO TO ENTER INTO A CONTRACT WITH DLZ OHIO, INC. OF CLEVELAND, OHIO TO PROVIDE PROFESSIONAL SERVICES FOR THE ERI-US6-28.37 LIBERTY AVENUE IMPROVEMENTS PROJECT (PID 115721) IN AN AMOUNT NOT TO EXCEED SEVENTY-SEVEN THOUSAND SIX HUNDRED NINETY-SIX DOLLARS ($77,696.00) AND DECLARING AN EMERGENCY.
WHEREAS, this City Council deems the proposal submitted by DLZ Ohio, Inc. of Cleveland, Ohio to be the lowest and best proposal.
NOW, THEREFORE, BE IT ORDAINED by the Council of the City of Vermilion, Counties of Erie and Lorain, State of Ohio:
SECTION 1: That the proposal submitted by DLZ Ohio, Inc. of Cleveland, Ohio to provide professional services for the ERI-US6-28.37 Liberty Avenue Improvements Project (PID 115721) in the City of Vermilion is hereby accepted.
SECTION 2: That the Mayor be and hereby is authorized and directed to make and enter into a contract on behalf of the City of Vermilion, Ohio with DLZ Ohio, Inc. of Cleveland, Ohio to provide professional services for the ERI-US6-28.37 Liberty Avenue Improvements Project (PID 115721) in the City of Vermilion, Ohio in an amount not to exceed Seventy-Seven Thousand Six Hundred Ninety-Six Dollars ($77,696.00). That the abovementioned contract will be made in strict accordance with the specifications and the proposal; the same to be considered a permanent part thereof as though fully rewritten therein, and herein is attached as Exhibit A.
SECTION 3: This Council finds and determines that all formal actions of this Council concerning and relating to the passage of this Ordinance were taken in an open meeting of this Council and that all deliberations of this Council and of any committees that resulted in those formal actions were in meetings open to the public and in compliance with all legal requirements, including Section 121.22 of the Ohio Revised Code.
SECTION 5: That this Ordinance is declared to be an emergency for the public peace, health, and safety of the City; being the necessity to begin the project; wherefore, this Ordinance shall take effect immediately upon its passage and approval of the Mayor, providing it meets the statutory requirements for passage; otherwise, it shall take effect and be enforced from and after the earliest period allowed by law.
