2023-53 COMPENSATION OF CERTAIN AUTHORIZED POSITIONS WITHIN THE VERMIL

2023-53 AN ORDINANCE AMENDING ORDINANCE 2022-16 ADOPTED APRIL 4, 2022 BY ESTABLISHING COMPENSATION OF CERTAIN AUTHORIZED POSITIONS WITHIN THE VERMILION DEPARTMENT OF PARKS AND RECREATION AS HAVE BEEN FAVORABLY RECOMMENDED BY THE CITY’S PARKS AND RECREATION BOARD AND DECLARING AN EMERGENCY.

WHEREAS, the Vermilion Parks and Recreation Board at their meeting of July 18, 2023, favorably recommended to the Vermilion City Council to amend the pay rates for the Vermilion Community Pool lifeguards.

NOW, THEREFORE, BE IT ORDAINED, by the Council of the City of Vermilion, Counties of Erie and Lorain, State of Ohio:

SECTION 1: That the Service Director, upon the recommendation of the Vermilion Parks and Recreation Board and the Parks Operation Director is hereby authorized to employ up to fifteen (15) lifeguards.  New lifeguards shall be paid at a rate of $12.00 per hour, and second year returning lifeguards shall be paid at a rate of $12.50 per hour, and third year returning lifeguards shall be paid at a rate of $13.00 per hour.  

SECTION 2: That this city council at the recommendation of the Vermilion Parks and Recreation Board shall retroactively pay the third-year lifeguard $13.00 per hour for the 2023 season upon the effective date of this ordinance.

SECTION 3: That all appointments referred to herein shall be considered seasonal part-time personnel of the City of Vermilion and shall be within the non-classified, non-competitive service and shall receive no fringe benefits.

SECTION 4:  This Council finds and determines that all formal actions of this Council concerning and relating to the passage of this Ordinance were taken in an open meeting of this Council and that all deliberations of this Council and of any committees that resulted in those formal actions were in meetings open to the public and in compliance with all legal requirements, including Section 121.22 of the Ohio Revised Code.

SECTION 5:  That this Ordinance is hereby declared to be an emergency measure necessary for the immediate preservation of the public peace, health, and safety of the City; and the necessity being the city needs to retroactively pay the third year lifeguard their pay rate of $13.00 per hour prior to the end of the season, wherefore, it shall take effect and go into full force immediately upon its passage and approval of the Mayor, otherwise, it shall take effect and be enforced from and after the earliest period allowed by law.
