AN ORDINANCE AUTHORIZING AND DIRECTING THE MAYOR OF THE CITY OF VERMILION, OHIO TO ENTER INTO A PURCHASE AGREEMENT WITH MURPHY TRACTOR & EQUIPMENT OF BRUNSWICK, OHIO FOR THE PURCHASE OF A 2024 JOHN DEERE 310 BACKHOE TO BE USED IN THE DISTRIBUTION DEPARTMENT AND AUTHORIZING THE FINANCE DIRECTOR TO MAKE PAYMENT TO SAID AWARDEE IN AN AMOUNT NOT TO EXCEED ONE HUNDRED TWENTY-EIGHT THOUSAND FOUR HUNDRED TWELVE DOLLARS AND NINETY-FIVE CENTS ($128,412.95) AND DECLARING AN EMERGENCY.

            WHEREAS, the Director of Public Services deems it in the best interest of the City of Vermilion to purchase a 2024 John Deere 310 Backhoe to be used in the Distribution Department.

            NOW, THEREFORE, BE IT ORDAINED by the Council of the City of Vermilion, Counties of Erie and Lorain, State of Ohio:

            SECTION 1: That the Mayor be and hereby is authorized and directed to enter into a purchase agreement with Murphy Tractor & Equipment of Brunswick, Ohio for the purchase of a 2024 John Deere 310 Backhoe to be used in the Distribution Department and authorizing the Finance Director to make payment to said awardee in an amount not to exceed One Hundred Twenty-Eight Thousand Four Hundred Twelve Dollars and Ninety-Five Cents ($128,412.95)  That the abovementioned agreement will be made in strict accordance with the specifications; the same to be considered a permanent part thereof as though fully rewritten therein.

           SECTION 2: This Council finds and determines that all formal actions of this Council concerning and relating to the passage of this Ordinance were taken in an open meeting of this Council and that all deliberations of this Council and of any committees that resulted in those formal actions were in meetings open to the public and in compliance with all legal requirements, including Section 121.22 of the Ohio Revised Code.

            SECTION 3:  That this Ordinance is declared to be an emergency measure necessary for the public peace, health, and safety of the city, and for the further reason that it is necessary to order the equipment necessary to be used in the Vermilion Distribution Department and to expedite the delivery process. Wherefore, this Ordinance shall take effect immediately upon its passage and approval of the mayor, providing it meets the statutory requirements for passage; otherwise, it shall take effect and be enforced from and after the earliest period allowed by law.
