2023-8 PURCHASE OF POLYALUMINUM CHLORIDE

AN ORDINANCE AUTHORIZING AND DIRECTING THE MAYOR OF THE CITY OF VERMILION, OHIO TO ENTER INTO A CONTRACT WITH USALCO, LLC OF BALTIMORE, MARYLAND FOR THE PURCHASE OF POLYALUMINUM CHLORIDE TO BE USED IN THE VERMILION UTILITIES DEPARTMENT AND DECLARING AN EMERGENCY.

WHEREAS, bids were duly advertised on January 12 and January 19, 2023, and,

WHEREAS, on January 26, 2023, bids for said chemical were received and duly opened by the Service Director of the City of Vermilion, and,

WHEREAS, this Council deems the bid of USALCO, LLC of Baltimore, Maryland to be the lowest and best bid.

NOW, THEREFORE BE IT ORDAINED by the Council of the City of Vermilion, Counties of Erie and Lorain, State of Ohio:

SECTION 1: That the bid ofUSALCO, LLC ofBaltimore, Maryland for the purchase of Polyaluminum Chloride is hereby accepted.

SECTION 2: That the Mayor of the City of Vermilion, Ohio is hereby authorized and directed to enter into a contract with USALCO, LLC of Baltimore, Maryland for the purchase of the following: Polyaluminum Chloride $0.275/per wet pound.

SECTION 3: That this contract will be made in strict accordance with the specifications and the bid; the same to be considered a permanent part thereof as though fully rewritten therein.

SECTION 4: This Council finds and determines that all formal actions of this Council concerning and relating to the passage of this Ordinance were taken in an open meeting of this Council and that all deliberations of this Council and of any committees that resulted in those formal actions were in meetings open to the public and in compliance with all legal requirements, including Section 121.22 of the Ohio Revised Code.

SECTION 5: That this Ordinance is declared to be an emergency for the public peace, health, and safety of the city; and the necessity being the water plant has this chemical in inventory to run the plant efficiently. Wherefore, this Ordinance shall take effect immediately upon its passage and approval of the mayor, providing it meets the statutory requirements for passage; otherwise, it shall take effect and be enforced from and after the earliest period allowed by law.
