2024-26 SUPPLEMENT CONTRACTUAL SERVICES BY BRAMHALL ENGINEERING

2024-26 AN ORDINANCE TO OFFICIALLY SUPPLEMENT THE MINIMUM CONTRACTUAL SERVICES TO BE PERFORMED BY BRAMHALL ENGINEERING & SURVEYING COMPANY BY VIRTUE OF ORDINANCE 2018-5 ADOPTED JANUARY 2, 2018, BY AUTHORIZING PROFESSIONAL DESIGN ENGINEERING SERVICES RELATED TO THE 2024 STREET PROGRAM (NAUTICAL & LARCHMONT); PRESCRIBING THAT THE FIRM SHALL BE PAID FOR ADDITIONAL SERVICES IN ACCORDANCE WITH THE  RATE SCHEDULE SET FORTH IN THE PROPOSAL DATED JANUARY 3, 2018, IN A TOTAL AMOUNT NOT TO EXCEED THIRTY ONE THOUSAND FIVE HUNDRED DOLLARS ($31,500) AND DECLARING AN EMERGENCY.

 WHEREAS, Ordinance 2018-5 sets a schedule of minimum duties to be performed by Bramhall Engineering & Surveying Company, the official Consulting Engineering Firm of the City; and

WHEREAS, such ordinance permits this Council to retain the Engineering Firm for additional projects; and

 

WHEREAS, this Council deems it appropriate to retain the Engineering Firm for professional design engineering services for the 2024 Street Program (Nautical & Larchmont).

NOW, THEREFORE, BE IT ORDAINED by the Council of the City of Vermilion, Counties of Erie and Lorain, State of Ohio:

SECTION 1: That in accordance with the terms and conditions of Ordinance 2018-5, this Council hereby authorizes and directs said professional engineering firm to undertake and perform additional and supplemental services at the rates set forth in said ordinance to provide professional design engineering services for the 2024 Street Program (Nautical & Larchmont) in a total amount not to exceed Thirty-One Thousand Five Hundred Dollars ($31,500.00)

SECTION 2:  This Council finds and determines that all formal actions of this Council concerning and relating to the passage of this Ordinance were taken in an open meeting of this Council and that all deliberations of this Council and of any committees that resulted in those formal actions were in meetings open to the public in compliance with the law. 

SECTION 3:    This Ordinance is declared to be an emergency for the public peace, health, and safety of the city; the emergency necessity being that the project can begin during the summer season. Wherefore, this Ordinance shall take effect immediately upon its passage and approval of the mayor, providing it meets the statutory requirements for passage; otherwise, it shall take effect and be enforced from and after the earliest period allowed by law.
