2024-33 AN ORDINANCE AUTHORIZING AND DIRECTING THE MAYOR OF THE CITY OF VERMILION, OHIO TO ENTER INTO A PURCHASE AGREEMENT WITH HENDERSON PRODUCTS, INC. OF BUCYRUS, OHIO FOR THE PURCHASE OF A 2024 SINGLE AXLE MUNIBODY SNOW & ICE CONTROL TRUCK EQUIPMENT PACKAGE TO BE USED IN THE VERMILION STREET DEPARTMENT AND AUTHORIZING THE FINANCE DIRECTOR TO MAKE PAYMENT TO SAID AWARDEE IN AN AMOUNT NOT TO EXCEED ONE HUNDRED THIRTY-TWO THOUSAND ONE HUNDRED EIGHTY DOLLARS ($132,180.00) AND DECLARING AN EMERGENCY.
WHEREAS, the Director of Public Services deems it in the best interest of the City of Vermilion to purchase a 2024 Single Axle Munibody Snow & Ice Control Truck Equipment Package to be used in the Vermilion Street Department.
NOW, THEREFORE, BE IT ORDAINED by the Council of the City of Vermilion, Counties of Erie and Lorain, State of Ohio:
SECTION 1: That the Mayor be and hereby is authorized and directed to enter into a purchase agreement with Henderson Products, Inc. of Bucyrus, Ohio for the purchase of a 2024 Single Axle Munibody Snow & Ice Control Truck Equipment Package to be used in the Vermilion Street Department and authorizing the Finance Director to make payment to said awardee in an amount not to exceed One Hundred Thirty-Two Thousand One Hundred Eighty Dollars ($132,180.00). That the abovementioned agreement will be made in strict accordance with the specifications; the same to be considered a permanent part thereof as though fully rewritten therein.
SECTION 2: This Council finds and determines that all formal actions of this Council concerning and relating to the passage of this Ordinance were taken in an open meeting of this Council and that all deliberations of this Council and of any committees that resulted in those formal actions were in meetings open to the public and in compliance with all legal requirements, including Section 121.22 of the Ohio Revised Code.
SECTION 3: That this Ordinance is declared to be an emergency measure necessary for the public peace, health, and safety of the city, and for the further reason that it is necessary to order the equipment necessary to be used in the Vermilion Street Department and to expedite the outfitting and delivery process so it can be put in service by the 2024 winter season. Wherefore, this Ordinance shall take effect immediately upon its passage and approval of the mayor, providing it meets the statutory requirements for passage; otherwise, it shall take effect and be enforced from and after the earliest period allowed by law.
