2024-37 GRANTING AN EASEMENT 699 TOLEDO STREET

2024-37 AN ORDINANCE GRANTING AN EASEMENT AGREEMENT (“AGREEMENT”) BY AND BETWEEN THE CITY OF VERMILION (“GRANTOR”) OF 5511 LIBERTY AVENUE, VERMILION, OHIO, AND GARY C. MOYSE AND NICOLE M. MOYSE (JOINTLY AND SEVERALLY, “GRANTEE”) OF 699 TOLEDO STREET, VERMILION, OHIO (“GRANTEE’S PROPERTY”) AND DECLARING AN EMERGENCY.

 

WHEREAS, the Vermilion City Council desires to grant an easement agreement by and between the City of Vermilion (“Grantor”) of 5511 Liberty Avenue, Vermilion, Ohio and Gary C. Moyse and Nicole M. Moyse (jointly and severally, “Grantee”) of 699 Toledo Street, Vermilion, Ohio (“Grantee’s Property”).

 

NOW, THEREFORE BE IT ORDAINED by the Council of the City of Vermilion, Counties of Erie and Lorain, State of Ohio:

 

SECTION 1:  That this Council of the City of Vermilion hereby grants an easement agreement by and between the City of Vermilion (“Grantor”) of 5511 Liberty Avenue, Vermilion, Ohio and Gary C. Moyse and Nicole M. Moyse (jointly and severally, “Grantee”) of 699 Toledo Street, Vermilion, Ohio (“Grantee’s Property”) as shown in Exhibit A as attached hereto and incorporated herein.

 

SECTION 2:  This Council finds and determines that all formal actions of this Council concerning and relating to the passage of this Ordinance were taken in an open meeting of this Council and that all deliberations of this Council and of any committees that resulted in those formal actions were in meetings open to the public and in compliance with all legal requirements, including Section 121.22 of the Ohio Revised Code.

 

SECTION 3:  That this Ordinance is hereby declared to be an emergency measure; the emergency being the necessity in that the parking determination is critical in starting the exterior work in the summer season of 2024, thus for the public peace, health, and safety of the City; wherefore, this Ordinance shall take effect immediately upon its passage and approval of the Mayor, providing it meets the statutory requirements for passage; otherwise, it shall take effect and be enforced from and after the earliest period allowed by law.
