2025-42 2025-42 ENTER CONTRACT WITH NORWALK CONCRETE

2025-42 AN ORDINANCE AUTHORIZING AND DIRECTING THE MAYOR OF THE CITY OF VERMILION, OHIO TO ENTER INTO A CONTRACT WITH NORWALK CONCRETE INDUSTRIES OF NORWALK, OHIO FOR THE PURCHASE AND PARTIAL INSTALLATION OF PRE-MANUFACTURED RESTROOMS AT SHEROD PARK; AUTHORIZING THE FINANCE DIRECTOR TO MAKE PAYMENT IN AN AMOUNT NOT TO EXCEED SEVENTY-SEVEN THOUSAND FOUR HUNDRED SIXTY DOLLARS ($77,460.00) AND DECLARING AN EMERGENCY.

                                                                                   

            WHEREAS, on August 20, 2024, the Vermilion Parks and Recreation Board favorably made a motion to accept funding in the amount of $85,000 from the Erie County Commissioners with regards to the Erie County Community Investment Grant and to authorize matching funds in the amount of $20,000 allocated through the Parks Levy Fund 204, and to authorize the restrooms to be built and transported from Norwalk Concrete.

 

            WHEREAS, on May 1 and May 8, 2025, bids for said improvements were duly advertised in the Vermilion Photojournal and,

 

            WHEREAS, on May 22, 2025, bids for said improvements were received and duly opened by Marc Weisenberger, and,      

 

WHEREAS, this City Council deems Norwalk Concrete Industries of Norwalk, Ohio to be the lowest and best bid,

 

            NOW, THEREFORE, BE IT ORDAINED by the Council of the City of Vermilion, Counties of Erie and Lorain, State of Ohio:

 

            SECTION 1: That the bid submitted by Norwalk Concrete Industries of Norwalk, Ohio for the purchase and partial installation of pre-manufactured restrooms at Sherod Park in the City of Vermilion is hereby accepted.

 

            SECTION 2: That the Mayor be and hereby is authorized and directed to make and enter into a contract with Norwalk Concrete Industries of Norwalk, Ohio for the purchase and partial installation of pre-manufactured restrooms at Sherod Park on behalf of the City of Vermilion, Ohio in an amount not to exceed Seventy-Seven Thousand Four Hundred Sixty Dollars ($77,460.00) to be allocated from Fund 217 (Sherod) and Fund 204 (Parks Capital). That the abovementioned contract will be made in strict accordance with the specifications and the bid; the same to be considered a permanent part thereof as though fully rewritten therein.         

 

            SECTION 3: This Council finds and determines that all formal actions of this Council concerning and relating to the passage of this Ordinance were taken in an open meeting of this Council and that all deliberations of this Council and of any committees that resulted in those formal actions were in meetings open to the public and in compliance with all legal requirements, including Section 121.22 of the Ohio Revised Code.

 

            SECTION 4: That this Ordinance is declared to be an emergency for the public peace, health, and safety of the city; the emergency being the necessity of having the restrooms installed for the 2025 summer or fall season. Wherefore, this Ordinance shall take effect immediately upon its passage and approval of the mayor, providing it meets the statutory requirements for passage; otherwise, it shall take effect and be enforced from and after the earliest period allowed by law.
