2025-51 REZONING LAND IN VERMILION

2025-51 AN ORDINANCE ENACTED PURSUANT TO CHAPTER 1266 OF THE CODIFIED ORDINANCES OF VERMILION, REZONING LAND IN VERMILION, OHIO, AND CONTAINING AN AREA OF APPROXIMATELY .5636 ACRES FROM R-5 “APARTMENT RESIDENCE DISTRICT” TO B-3 “HIGHWAY COMMERCIAL DISTRICT” LAND USE CLASSIFICATION AS FAVORABLY RECOMMENDED BY THE VERMILION MUNICIPAL PLANNING COMMISSION; AUTHORIZING THE CITY ENGINEER TO AMEND THE OFFICIAL ZONING MAP OF THE CITY OF VERMILION TO CONFORM HEREWITH AS SAID MAP HAS BEEN ESTABLISHED BY SECTION 1268.02 CODIFIED ORDINANCES OF VERMILION UPON THE EFFECTIVE DATE HEREOF.

 

            WHEREAS, the Property (PPN 18-01582.000) containing .5636 acres is currently zoned R-5 “Apartment Residence District” and it has been requested that the Property be rezoned to B-3 “Highway Commercial District” and,

 

            WHEREAS, Planning Commission, at its regular meeting of August 6, 2025, has recommended to Council that the zoning classification of the Property be changed and,

 

            WHEREAS, City Council held a public hearing on the proposed zoning change on September 22, 2025, at 6:00 p.m.

 

            NOW, THEREFORE, BE IT ORDAINED by the Council of the City of Vermilion, Counties of Erie and Lorain, State of Ohio:

 

            SECTION 1:  That .5636 acres of property be rezoned from its current R-5 “Apartment Residence District” (PPN 18-01582.000) to B-3 “Highway Commercial District” land use classification, being more fully described in the legal description and sketches being appended hereto, identified as Exhibit A, and incorporated hereby by reference.  

 

            SECTION 3:  That, pursuant to Section 1268.02 of Vermilion’s Codified Ordinances, the City Engineer shall amend Vermilion’s Zoning Map to reflect the rezoning of the Property.

 

            SECTION 4:  That it is found and determined that all formal actions of this Council concerning and relating to the passage of this Ordinance were adopted in an open meeting of this Council and that all deliberations of this Council and of any of its committees that resulted in such formal actions were in meetings open to the public and in compliance with all legal requirements, including Section 121.22 of the Ohio Revised Code.

 

            SECTION 5:  That this Ordinance shall take effect thirty (30) days after its final passage by Council.
