2023-80 SALE OF A LAND-LOCKED PARCEL

2023-80 AN ORDINANCE AUTHORIZING THE SALE OF A LAND-LOCKED PARCEL OF REAL PROPERTY NOT NEEDED FOR MUNICIPAL PURPOSES AND DECLARING AN EMERGENCY.

WHEREAS, pursuant to the Article XVIII, Section 3, of the Ohio Constitution, the City has the right to exercise all powers of local self-government; and

WHEREAS, pursuant to Section II-2 of the City Charter, the city may exercise its powers in the manner prescribed by Charter or, if not prescribed in the Charter, in such a manner as the Council may determine; and 

WHEREAS, pursuant to Section III-9, General Ordinances, of the City Charter, this Council may approve the sale of property by ordinance read in full on three different days unless the requirement of such readings is dispensed of by an affirmative vote of two-thirds members of Council; and

WHEREAS, the City owns certain undeveloped real property with a parcel number of 0120027113062 identified by the Lorain County Auditor to have a market land value of One Thousand, Sixty Dollars and No Cents ($1,060.00); and

WHEREAS, parcel #0120027113062 is land-locked and not needed for municipal purposes; and

WHEREAS, this Council has determined it in the interests of the City to sell such Property; and

NOW, THEREFORE, BE IT ORDAINED by the Council of the City of Vermilion, Counties of Lorain and Erie, State of Ohio, that:

SECTION 1.  This Council declares the real property owned by the City with a parcel number of 0120027113062 to not be needed for municipal purposes and authorizes the Service Director to negotiate the sale of such property for a purchase price of no less than $2,000, to be memorialized in a written purchase agreement approved as to form by the Law Director and executed by the mayor. 

SECTION 2.  All formal actions of this Council related to this Ordinance and all deliberations of this Council and of any of its Committees that resulted in such formal action were in meetings open to the public in compliance with all legal requirements, including Section 121.22 of the Ohio Revised Code.

SECTION 3.  This Ordinance is declared to be an emergency measure necessary for the immediate preservation for the public peace, health and safety of the City and in order to facilitate the timely and efficient disposition of the real property authorized for sale herein,  and provided it receives approval of two-thirds of the members of Council, shall be in full force and effect from and after its approval by the Mayor, or otherwise take effect and be in force from and after the earliest period provided by law.
